Former Cabinet Secretary Raphael Tuju approaches High Court with a new petition to halt the auction of his valuable Karen properties, following a defaulted loan from the East African Development Bank. 

The petition, filed in the Constitutional and Human Rights Division, includes Tuju’s company, Dari Ltd and his children as co-petitioners. 

Together, they allege a breach of rights by five Supreme Court justices Deputy Chief Justice Philomena Mwilu, along with Justices Mohammed Khadar Ibrahim, Smokin Wanjala, Njoki Ndung'u and William Ouko who recused themselves from Tuju’s appeal.

Tuju seeks not only to prevent the EADB from selling, sub-dividing, or alienating the properties, two of Nairobi's high-end assets (Entim Sidai Wellness Sanctuary, Tamarind Karen and Dari Business Park) located in Karen but also to have the court declare that judicial recusals, particularly at the Supreme Court level, should not occur if they obstruct quorum requirements.

Tuju contends that the earliest date a fully constituted Supreme Court could hear his appeal would be in 2036, due to the recusals. 

In an interim measure, he has requested the High Court to maintain the current state of affairs regarding the properties, registered as LR No. 11320/3 and LR No. 1055/165, until the case is resolved.

Garam Investments Auctioneers recently announced the sale of one of the properties to an undisclosed buyer for Ksh 450 million, a fraction of the Ksh 4.5 billion ($35,057,622) debt Tuju reportedly owes EADB.

PRODUCER CEDO SPEAKS ON FALLOUT WITH NYASHINSKI

Music producer Cedrick ‘Cedo’ Kadenyi has broken his silence over rumors surrounding his friendship with rapper and singer Nyashinski. The two reportedly fell out over a lucrative business deal. In June, Nyashinski reportedly asked Cedo to produce jingles for a client, offering Sh1 million for his work on a deal valued at Sh10 million.
