The impeachment process was a show trial with a predetermined outcome. It was an exercise full of illegalities, irregularities and even criminalities. Everything was timed to the second to ensure that Gachagua wouldn't get justice from the courts in terms of injuncting the process.
This ruthless efficiency and muted opposition at whatever stage is consistent with dictatorship. What else can't the MPs pass under these circumstances? With a spineless DP in place, the dictatorial loop is complete in all its elements. The drama has just started.
Hopefully, the judiciary will redeem itself and declare the entire charade null and void. I doubt there is any self-respecting court which can legitimise what has happened in the last two weeks. Sadly, by the time such a ruling is made, it will be too late since we will no longer be operating under the rule of law. The court's decision will almost certainly be meaningless.
The greatest loss in this process is not to Gachagua but to the country. Those who are celebrating have no idea what they are cheering. The coming days will be difficult. The economic and political oppression of the past will look like a Sunday school brawl. Ultimately, these things will destabilise the country.
The regime has the leaders in its pockets but the people are not with it. The great disconnect between the leaders and the people will play out in the coming days. Those who think that they can return the nation to the dark days of dictatorship are mistaken. Freedom will be defended and dictatorship will be defeated. The people will prevail!
According to the constitution, the right to a fair trial cannot be limited even by other provisions of the constitution such as timelines. One of the key constitutional issues in the Gachagua impeachment was the high number of charges that were preferred.
The 11 charges made it impossible for a fair trial to be conducted. It is like being charged with 11 court cases at once. Then you are given two hours to defend yourself. The overwhelming number of charges were clearly calculated to defeat justice. It was a fishing expedition meant to ensure that at least one of the charges was upheld.
It was impossible even for the Senate to meaningfully go through all the 11 charges and the evidence adduced. The voluminous and convoluted charges made a fair trial impossible. It should be remembered that one of the reasons why the BBI failed was because of the many constitutional changes that were being pushed at once. This will come into focus once again.
What is all this hurry for if what is being done is for the good of the country? How are these things expected to survive legal scrutiny in our courts?
